Lexmark and Agricultural Department Strike a Deal | WebProNews

Lexmark International is a Lexington, Kentucky-based company who serves clients all over the globe. Servicing over 170 countries, they generated over $4 billion in revenue last year. Today they announce they have landed a deal worth over $50 million with the United States Agricultural Department (USDA).

On top of professional printing services, Lexmark will also provide workflow solutions, process management, and output optimization under the contract. The contract is good for five years and will carry Lexmark and the USDA into 2017.

?A Los Angeles judge on Thursday lifted formal probation for Lindsay Lohan, freeing the actress from court appearances and official supervision that have ruled her life since a 2007 drunk driving arrest.

Lohan, 25, who has made multiple trips to jail and rehab in the past four years, got good marks from Los Angeles Superior Court judge Stephanie Sautner for completing months of community service at a Los Angeles morgue and court-ordered psychotherapy sessions.

The actress and her attorney, Shawn Holley, thanked the judge, and Lohan said that the judge's fairness "really opened a lot of doors for me."

Judge Sautner advised Lohan to obey all laws, stay out of nightclubs, and concentrate on her work. She noted that she realized Lohan had photographers and reporters following her, but said "That's the life you chose."

Although the "Mean Girls" actress will remain on informal probation for a 2011 jewelry theft, she will not have to report regularly to court and will no longer be compelled to live in Los Angeles, as long as she stays out of trouble for the next 2 1/2 years.

Lohan's once promising movie career was derailed by years of hard partying and personal turmoil. But the former "Parent Trap" child star is now on the comeback trail, with an upcoming guest part in TV musical "Glee" and a TV movie role as screen legend Elizabeth Taylor.

(AP) ? The heart of the Obama administration's health care overhaul hanging in the balance, the Supreme Court is turning to whether the rest of the law can survive if the crucial individual insurance requirement is struck down.

The justices also will spend part of Wednesday, the last of three days of arguments over the health law, considering a challenge by 26 states to the expansion of the Medicaid program for low-income Americans, an important feature toward the overall goal of extending health insurance to an additional 30 million people.

The first two days of fast-paced and extended arguments have shown that the conservative justices have serious questions about Congress' authority to require virtually every American to carry insurance or pay a penalty.

The outcome of the case will affect nearly all Americans and the ruling, expected in June, also could play a role in the presidential election campaign. Obama and congressional Democrats pushed for the law's passage two years ago, while Republicans, including all the GOP presidential candidates, are strongly opposed.

But the topic the justices take up Wednesday only comes into play if they first find that the insurance mandate violates the Constitution. If they do, then they will have to decide if the rest of the law stands or falls.

The states and the small business group opposing the law say the insurance requirement is central to the whole undertaking and should take the rest of the law down with it.

The administration argues that the only other provisions the court should kill in the event the mandate is stricken are insurance revisions that require insurers to cover people regardless of existing medical problems and limit how much they can charge in premiums based on a person's age or health.

The federal appeals court in Atlanta that struck down the insurance requirement said the rest of the law can remain in place, a position that will be argued by a private lawyer appointed by the justices, H. Bartow Farr III.

On Tuesday, the conservative justices sharply and repeatedly questioned the validity of the insurance mandate.

If the government can force people to buy health insurance, justices wanted to know, can it require people to buy burial insurance? Cellphones? Broccoli?

The court focused on whether the mandate for Americans to have insurance "is a step beyond what our cases allow," in the words of Justice Anthony Kennedy.

"Purchase insurance in this case, something else in the next case," Chief Justice John Roberts said.

But Kennedy, who is often the swing vote on cases that divide the justices along ideological lines, also said he recognized the magnitude of the nation's health care problems and seemed to suggest they would require a comprehensive solution.

And Roberts also spoke about the uniqueness of health care, which almost everyone uses at some point.

"Everybody is in this market, so that makes it very different than the market for cars or the other hypotheticals that you came up with, and all they're regulating is how you pay for it," Roberts said, paraphrasing the government's argument.

Kennedy and Roberts emerged as the apparent pivotal votes in the court's decision.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because the insurance requirement will provide insurance companies with more premiums from healthy people to cover the increased costs of care.

"If the government can do this, what else can it not do?" Justice Antonin Scalia asked. He and Justice Samuel Alito appeared likely to join with Justice Clarence Thomas, the only justice to ask no questions, to vote to strike down the key provision of the overhaul. The four Democratic appointees seemed ready to vote to uphold it.

Kennedy at one point said that allowing the government mandate would "change the relationship" between the government and U.S. citizens.

"Do you not have a heavy burden of justification to show authorization under the Constitution" for the individual mandate? asked Kennedy.

At another point, however, he also acknowledged the complexity of resolving the issue of paying for America's health care needs.

"I think it is true that if most questions in life are matters of degree ... the young person who is uninsured is uniquely proximately very close to affecting the rates of insurance and the costs of providing medical care in a way that is not true in other industries. That's my concern in the case," Kennedy said.

Justice Ruth Bader Ginsburg said she found the debate over health care similar to an earlier era's argument about the Social Security retirement system. How could Congress be able to compel younger workers to contribute to Social Security but be limited in its ability to address health care? she wondered.

"There's something very odd about that, that the government can take over the whole thing and we all say, Oh, yes, that's fine, but if the government wants to preserve private insurers, it can't do that," she said.

Obama says he's not 'hiding the ball' on Russia

SEOUL, South Korea (AP) ? Speaking to the microphones intentionally this time, President Barack Obama on Tuesday assured he had no hidden agenda with Russia for a second term, seeking to contain a controversial gaffe that bounded all the way to the campaign trail at home and back again.

Obama got caught on tape Monday telling Russian President Dmitry Medvedev that he would have more room to negotiate on missile defense after getting through a November election, presumably expecting to win and not have to face voters again.

Obama's Republican rivals back home pounced, accusing him of secretive plotting and dealing over American national security. So one day later, with Medvedev at his side again, Obama tried some on the record candor and humor to put it all to rest.

The president's explanation: He wants to work with Russia on the deeply divisive issue of a missile defense shield in Europe, knowing only by building trust first on that matter can he make gains on another goal of nuclear arms reductions. And there's no way to expect progress during the politics of this election year, so he is already looking to 2013.

"This is not a matter of hiding the ball," Obama said, well aware of criticism erupting at home. "I'm on record."

Still, Obama had not meant for his initial political assessment to be heard. It was picked up by live microphones during a meeting with Medvedev and soon shot around the world. "This is my last election," Obama was heard telling Medvedev, Russia's outgoing president. "After my election, I have more flexibility."

Obama showed up at a nuclear security summit ready to clarify his caught-on-tape words even at the risk of overshadowing his message for a second day. He fielded a question but failed to address the presumptuousness of plotting out 2013 strategy with Russia when, in fact, he must win election again for any of that to matter.

For Russia, the issues of nuclear weapons reduction and the proposed missile shield are related. Russian fears of new U.S. missiles at its doorstep in Europe have helped to stymie further progress on nuclear arms reductions after a breakthrough agreement two years ago.

Obama said he wants to spend the rest of this year working through technical issues with the Russians, and said it was not surprising that a deal couldn't be completed quickly.

"I don't think it's any surprise that you can't start that a few months before presidential and congressional elections in the United States, and at a time when they just completed elections in Russia, and they're in the process of a presidential transition," Obama told reporters. He spoke after making a separate announcement on nuclear security.

The president also sought twice to dispense with the controversy with a dash of humor.

Before taking his seat at the nuclear summit, he caught Medvedev's eyes and said "Wait, wait, wait, wait." Obama then covered up his microphone and jest, enjoying a hearty laugh and handshake with the Russian leader.

And when he decided to offer his explanation about the flap, Obama said, "first of all, are the mics on?"

Obama's candid remarks Monday illustrated the political constraints that hem in any president who is running for re-election and dealing with a congressional chamber ? in this case, the House ? controlled by the rival party.

Republicans have fought Obama fiercely on health care, taxes and other issues. They are eager to deny him any political victories in a season in which they feel the White House is within reach.

Mitt Romney, the leading Republican contender to face Obama this fall, told a San Diego audience the unguarded comments were "an alarming and troubling development."

"This is no time for our president to be pulling his punches with the American people, and not telling us what he's intending to do with regards to our missile defense system, with regards to our military might and with regards to our commitment to Israel," Romney said.

Romney, a former Massachusetts governor who often faces charges of having been flexible on his own policies over the years, also issued a statement saying Obama "needs to level with the American public about his real agenda."

Republican presidential candidate Newt Gingrich also questioned Obama's motives.

"I'm curious, how many other countries has the president promised that he'd have a lot more flexibility the morning he doesn't have to answer to the American people?" Gingrich said on CNN.

Neither Obama nor Medvedev knew they were being heard when they conferred quietly at what was billed as their last meeting of Medvedev's presidency. He leaves office in May, to be replaced by the incoming Vladimir Putin.

According to ABC News, Medvedev replied in English: "I understand. I will transmit this information to Vladimir."

Obama said the way the Republicans seized on his open-mic comments only made his point that the atmosphere is too politicized right now to advance arms control with Russia.

"The only way I get this stuff done is if I'm consulting with the Pentagon, if I'm consulting with Congress, if I've got bipartisan support, and the current environment is not conducive to those kinds of thoughtful consultations," Obama said. "I think we'll do better in 2013."

There, again, Obama's remarks suggested he feels good about his re-election prospects.

BATS exchange withdraws IPO after stumbles

NEW YORK (Reuters) - In a breakdown that resembled a mini version of the 2010 "flash crash," a series of glitches hit the market debut of BATS Global Markets Inc on Friday, causing the company to take the extremely rare step of withdrawing its initial public offering of shares.

The problems caused the shares of exchange operator BATS to plunge from their $16 offering price and briefly trade for less than a penny on Friday morning, creating havoc in the marketplace and again calling into question the stability of high-speed trading.

The glitches, which also prompted a halt in trading of Apple Inc shares, were so severe and so visible, involving BATS' own listing, that some observers said they threatened confidence in the nation's third-largest exchange.

This was the first IPO on the BATS exchange.

"I think some companies might say ?If they can't handle the IPO of their own stock, how can they handle the IPO of our stock?'," said Dennis Dick, a Detroit-based market structure consultant and trading member at Bright Trading LLC. "There is going to be a confidence issue of listing on BATS."

BATS, an acronym for "Better Alternative Trading System," suspended trading in BATS shares and alerted investors to "system issues" around mid-morning in New York. The exchange, a rival to the New York Stock Exchange and Nasdaq that is based in Kansas City, Mo., later said the problems had been resolved and BATS shares would resume trading at noon.

Late in the day, BATS said trading would not resume, and later said it had decided to unwind its share offering.

Eight hours after the problem started the company blamed a "software bug" for setting off the series of glitches.

"In the wake of today's technical issues, which affected the trading of certain stocks, including that of BATS, we believe withdrawing the IPO is the appropriate action to take for our company and our shareholders," said Joe Ratterman, chief executive officer of BATS Global Markets.

The debacle raised questions for regulators, investors and the underwriters, including Citigroup Inc, Morgan Stanley and Credit Suisse Group, which were listed before the IPO as major shareholders.

Several former or current Credit Suisse bankers serve on BATS' board, according to a BATS regulatory filing. Big shareholders that planned to exit were Getco LLC, a high-frequency trading firm based in Chicago, and Lehman Brothers Holdings Inc.

Unwinding the IPO would mean that the banks and other owners would have to return to investors about $100 million that they gained by selling their stakes in BATS.

Also in play are millions of dollars in fees the banks would have received in fees for doing the underwriting. The episode also could open the door to lawsuits and put BATS' expansion plans on hold.

BATS made a big leap into the European market in December when it completed the $300 million takeover of rival Chi-X Europe. The two exchanges had about a quarter of European share trading on their systems at the time. BATS also was said to be looking for an acquisition in Brazil, as well as planning to create new platforms for other asset classes.

The one positive note about the trading problems was that BATS quickly caught the mistake and halted the problematic trading.

"The public should take comfort that circuit breakers are working as they should after the flash crash," said Holly Stark managing member of Efficient Frontiers, a market structure consulting firm in New York.

Since the May 2010 "flash crash" in which nearly $1 trillion in market value disappeared in minutes, the Securities and Exchange Commission under Chairman Mary Schapiro has pledged to crack down on problems in the high-speed electronic marketplace, which regulators worry has grown unstable and perhaps unfair as high-frequency trading has grown in prominence.

The BATS breakdown could trip up, once again, the march over the last decade toward increasingly automated markets in the United States, Europe and elsewhere.

It is expected to draw even more scrutiny from regulators looking into the soundness of the exchange's servers, trade-matching engines and computer codes, and it could land BATS in legal trouble for withdrawing its IPO after trades were executed in the public marketplace, according to experts.

The SEC regularly visits exchanges and has in the past few months requested detailed information on how orders are routed and executed, according to sources with direct knowledge of the matter.

"As is our practice, SEC staff has been and will continue to be in discussions with BATS to determine the cause and extent of the incident and steps BATS is taking to remedy the situation," said John Nester, and SEC spokesman.

The software bug rendered opening orders for BATS stock inaccessible, the exchange said in a "post-mortem" late on Friday. Once it decided Friday afternoon to withdraw the IPO, the original trade in BATS stock was "torn down." BATS then broke other trades and let all affected parties know about the decision, BATS said.

There is precedent for canceling trades. After the 2010 flash crash, regulators and exchanges agreed to cancel the 20,000 trades that were executed more than 60 percent away from the pre-crash prices of those stocks. The trades were deemed "clearly erroneous," canceling out some big losses - and big profits - for many traders that day.

But BATS' explanation of how it handled the situation came late for those who had agreed to buy shares in the IPO.?As BATS officials worked to fix the system breakdown, no one from the exchange publicly explained what had gone wrong. This left institutional investors nervous about their agreement to buy shares, according to people close to the situation.

Increased discomfort among those buyers could have played a role in the decision to cancel the IPO, the sources said.

Founded in 2005, the BATS exchange has captured about 11 percent of U.S. equity market volume and 3 percent of equity options volume and is now the third-largest platform in the U.S., after the NYSE Euronext and Nasdaq OMX .

BATS, headed by 45-year-old Ratterman, was formed by major banks and trading firms looking to break the stranglehold that the NYSE and Nasdaq had on U.S. stock trading, forcing the traditional venues to modernize their technology.

It was started with 13 employees by David Cummings, a computer and electrical engineering graduate of Purdue University. Cummings is the chairman of Tradebot Systems, an electronic trading firm that he founded in a spare bedroom with a $10,000 investment. The growth of Tradebot and BATS had established the Kansas City area as a hotbed for trading technology companies. In 2006, Mr. Cummings told a local Kansas City business newspaper, "Make no mistake, our long-term plan is to be one of the three largest equity markets in the United States."

Friday's market debut would have marked a major next step in the company's evolution.

But the day began badly, when the Wall Street Journal led its front page with a story saying BATS was part of a probe by the SEC into high-frequency trading. Although the investigation had been known for months, the story did little to allay concerns about the BATS exchange.

Then the spectacular trading glitch sparked fears and set tongues wagging on Wall Street.

"The one thing they should have guarded against is the integrity of their platform on the day they went public," said Francis Gaskins, president of IPO research site IPOdesktop.com, in Los Angeles.

As trading began on Friday, BATS stock dipped to $15.25. Then extreme turbulence hit. A slew of bad trades at less than a penny sent the stock plunging. Though the trades were later voided, the plunge unnerved investors.

Around the same time, three Apple trades also went through on the BATS exchange, triggering a circuit breaker that temporarily halted trading of Apple. Those trades ultimately were canceled.

BATS said its installation of software for its IPO triggered a bug just after 10:45 a.m. eastern time that affected all stocks whose ticker symbols began with letters A to BFZZZ?including BATS' own stock. It tried to remove all quotes in the affected stocks but three trades for Apple were executed. By 12:34 pm, the Apple trades were canceled.

By noon, the exchange notified its members that all symbols would be available for trading except for its own shares.

The omission of its own shares was probably the most?embarrassing and costly problem for BATS, and?ultimately led to its pulling of the IPO, said Larry Tabb, founder of Tabb Group, a markets consulting firm.

"They pulled the IPO because their own symbol was affected," Tabb said. "They couldn't get it to work and it just degraded confidence in their marketplace."

A spokeswoman for the company said she had no immediate explanation for the decision to pull the IPO.

Spokespersons for the IPO underwriters either declined to comment or were not available for comment.

Market participants lost little time criticizing the exchange, and the event lit up the Twittersphere.

"It's just another black eye for the fragmented equity structure," said Joe Saluzzi, co-head of equity trading at Themis Trading in Chatham, New Jersey, and a frequent critic of U.S. equities market structure. "Every day we see things like flash crashes and now IPOs that can't get off the ground." On StockTwits.com, a stock-related Twitter site, commentators took aim at the company. "Man are those investors who participated in the IPO breathing a sigh of relief right now," wrote one.

The glitch on the first day did little to encourage investors. "The last thing you want to do as a listing exchange is mess up your introduction to the public investment world - the IPO," said Jason Weisberg, managing director at Seaport Securities Corp.

As a local and proud father of a Summit High Graduate and two tour war veteran of OIF and OEF, I am extremely offended by the cartoon posted in the March 22 Summit Daily News.

My son is still deployed in a hot zone in Afghanistan and is taking daily fire from hostiles both on the ground and in his Chinook. These young men and women are proud to serve and have volunteered to go anywhere in the world despite the disgusting politics of it all. In a time where we should be fully supporting our troops and helping those damaged by war coming home, they and their support families are faced with disgusting cartoons and commentaries such as the one posted in your paper. You guys should be ashamed of yourselves and recant this awful cartoon.

The star's latest ads for Helena Rubinstein's 2012 campaign have been released, and all we can focus our attention on is the massive amount of Photoshopping going on.

Let's see, there's absolutely no wrinkles or facial lines whatsoever, her nose and chin seem a different shape and suddenly, her tan has vanished. Yes, people always notice these things.

We understand that all ads and widely distributed photos get some retouching done, it's part of the biz, but it's Demi Moore. How much do you really have to fix?

Family built two grand Hamilton homes | Our History

HAMILTON ? Dick Scheid knows the Benninghofen family history about as well as anyone. Afterall, he and John W. Benninghofen?s great-great-grandaughter, Christin Carroll, wrote the book on it.

When asked about a ghost named ?Sarah? being connected to the 19th- and 20th-century Hamilton wool manufacturing family, he balked ? not because of any disbelief in ghosts.

?I just don?t recall a Sarah is what I?m saying,? he said.

John Benninghofen immigrated at age 29 from Prussia to Hamilton in 1848. He married fellow German Wilhelmina Klein six years later in Cincinnati and built a woolen mill with partner Asa Shuler in 1858.

The Shuler & Benninghofen factory, which was rebuilt twice and ended up at 2346 Pleasant Ave. (Ohio 127) in Lindenwald, thrived. The Benninghofens had five children: Pete, Christian, Pauline, Caroline and Wilhelmina. The two boys eventually took over for their father, and the company stayed in the families until 1967, when it merged with Orr Felt Co. of Piqua, Ohio.

Carroll wrote the family history part of the 2010 book ?Benninghofen: A House, a Family, a Legacy.? Scheid, a Hamilton native and retired science teacher who is a volunteer docent and researcher for the Butler County Historical Society, wrote about the family?s Hamilton houses.

Today, Scheid works in one of those houses, a Civil War-era brick Italianate at 327 N. Second St. that John Benninghofen bought in 1878. Since 1947, it has been the Butler County Historical Museum, home of the historical society.

A thrifty man, Scheid said, Benninghofen bought the house after its second owner, former sheriff Maj. Alfred Phillips, got into trouble with the law.

?Maj. Phillips hadn?t paid his back taxes, and there had been a big panic in 1877 that did a lot of people in,? Scheid said. The story goes that Benninghofen outbid the former sheriff in ? twist of irony here ? a sheriff?s sale.

The Benninghofen children grew up on Second Street. Second son Christian married and built a large Victorian mansion at 807 Dayton St., where he and his wife, Anna, raised their children: Elsa, Paul, Mark and Margaret. Great-grandchildren of John Benninghofen included Mark?s daughters Eleanor, Margaret Anne and Christine.

Christian also had a summer house with stables and trails built for his family in the southern part of Fairfield.

The family tree related to the three Benninghofen houses includes three generations down from John, none of whom were named ?Sarah,? the name of the alleged little ghost haunting the summer home in Fairfield.

Ghost stories aside, the Benninghofen?s took great care of their properties. All three houses and the factory still stand and are occupied.
